Exclusion of the Social Security's One-Time Economic Recovery Payments

Housing Notice 09-07 issued July 27, 2009   provides for the exclusion of the Social Security’s One-Time Economic Recovery Payments received by applicants for assisted housing and by tenants participating in HUD’s rental assistance programs from all purposes of determining eligibility and rent.  The American Recovery and Reinvestment Act of 2009, Pub. L. No. 111-5, 123 Stat. 115, requires this exclusion and the payments are an exclusion under 24 CFR 5.609(c)(9) of HUD’s regulation.
